We recommend advisers do seek consent to record the meeting from their clients at the start of the meeting. Most advisors do this verbally. Some examples of how advisers' message this request include:
- Are you ok for me to record this meeting?
- To ensure I capture everything we discuss, are you ok for me to record this meeting?
- Are you ok for me to record this meeting? We are using AI to help us write our meeting notes to enable us to free up time and add value to our clients in other ways.
Feedback from existing advisers using our solution is that clients are largely very receptive and there is minimal push back to this request.
In terms of documenting the consent, we have seen advisers:
- Add to the file note stating the client has consented to being recorded
- Rely on the start of the transcript to prove consent has been asked (e.g., confirming you are comfortable being recorded etc.)
- Insert a clause into the annual agreement/fixed term agreement stating that the adviser may record the session for the purpose of file noting
